Bucharest, January 12, 2012: bpv GRIGORESCU ŞTEFĂNICĂ obtained a favorable court decision for the Bucharest Municipality, against the petitioner Sema Parc S.A., in the dispute initiated by the latter company to cancel the construction permit no. 209/21.06.2010, issued by the Bucharest Municipality.
Starting with 2010, the Bucharest Municipality has initiated a city infrastructure project of big proportions, meant at the implementation of an integrated solution for systematizing the traffic in Bucharest and adjacent areas. The first stage of the project aims at decongesting the traffic on Iuliu Maniu St., by creating an alterna-tive entrance/exit road to/from the A1 highway, through building a new connecting road between Splaiul Inde-pendentei and A1 highway. In accordance with the construction permit no. 209/21.06.2010, these construction works impose/enforce the implementation of a new traffic solution solution foreseen to overpass Dâmbovița River.
Sema Parc requested the cancelation of the construction permit no. 209/21.06.2010 urgently authorizing the construction works for “penetration of Bucharest City by Bucharest-Pitesti Motorway – Splaiul Independentei – Preparation works for stay-cable bridge over Dambovita, between Piatra Craiului St. and Virtutii St.”. Since 2006, the contesting party is developing a real estate project in the area of Splaiul Independentei-Semanatoarea area, and the petition submitted in 2010 claims that the traffic solution foreseen to overpass Dâmbovița River within the infrastructure project started by Bucharest Municipality, would have negative im-pacts on the future operation and profitability of the real estate project developed by Sema Parc.
bpv GRIGORESCU ŞTEFĂNICĂ obtained the dismissal of the claim lodged by Sema Parc, with the Court of First Instance issuing the decision no. 4449/22.12.2011 considering the claim ungrounded and deciding on carrying on the infrastructure project started by Bucharest Municipality. The petitioner was represented in Court by Țuca, Zbârcea & Asociații.
