The procurement procedure for rail transportation services was initiated in March 2011 by The Autonomous Administration of Nuclear Activities (Regia Autonoma pentru Activitati Nucleare – RAAN), as contracting authority. Initially, the Romanian National Railway Company (Compania Nationala de Cai Ferate – CFR) was declared winner of the tender. GFR has challenged the tender with the National Council for Solving Complaints (NCSC), asking for the cancellation of RAAN’s decision, of the proceedings report and of the communication notice No. 2454/11.05.2011. CNSC dismissed GFR’s challenge as unsubstantiated by decision No. 2358/C9/2418.
GFR filed a complaint with The Court of Appeal Craiova against the decision of CNSC. In a final and irevocable decision, the Court of Appeal upheld the complaint and ordered the amendment of decision No. 2358/C9/2418 of 08.06.2011 issued by CNSC in order to admit the complaint, to cancel the proceedings re-port No. 5198/05.05.2011 and the communication notice No. 2454/11.05.2011 and to restart the procurement procedure.

At the end of last month, bpv GRIGORESCU STEFANICA successively obtained three dismissals of claims for cancellation of the procurement procedure in front of the National Council for Solving Complaints (NCSC). The client Grup Feroviar Roman (GFR) has been designated winner of the procurement procedure for transporta-tion services, initiated by the Romanian National Railway Company (Compania Nationala de Cai Ferate – CFR) in 2010. The estimated contract value exceeds RON 21 million, VAT not included. The acquisition is financed by the Romanian Ministry of Public Finance.
