Given the recent legislative changes and the evolving practice, we intend to look at harassment from two angles: how the law protects employees and how employees might misuse their rights. Within this topic, we will address issues such as how the anti-harassment procedure fits into the new legislative landscape and the early days of judicial practice, practical ways to distinguish between harassment and other inappropriate behaviours in the workplace, the key elements that can lead to the identification of harassment allegations made in bad faith and the legal consequences that arise from the interaction between harassment allegations and other procedures in the field of employment relations.
