In the context of the latest legislative changes and the recent case law of the CJEU, on 14 May 2024, we aim to discuss various ways in which employee performance appraisal can be aligned with organisational objectives. Based on various scenarios encountered in the day-to-day activity of employers, we will present practical solutions to avoid the "pitfalls" that employee performance appraisal can have. Within this framework, we will address topics such as: preparing and implementing procedures for evaluating employees' professional performance, setting evaluation criteria and individual performance targets, and evaluating employees in particular situations (e.g. during the probationary period, in case of possible professional unfit after the end of the probationary period, in case of individual or collective restructuring).
