On 18 May 2026, Law no. 64/2026 on the approval of Government Emergency Ordinance no. 91/2025 on the establishment of certain measures within the healthcare system (“Law 64/2026”) entered into force. This legislative act introduces a series of amendments and additions to the provisions of Government Emergency Ordinance no. 91/2025 on the establishment of certain measures within the healthcare system, some of which are listed below:
1. Clarifications regarding the indemnity payment in case of medical leave granted without interruption
In case of medical leave granted without interruption for an illness episode or complications arising therefrom, health insurance indemnities are calculated and paid with a single-day reduction, regardless of the number of medical leave certificates issued.
2. Exceptions regarding non-payment of the first day of medical leave indemnity
Law 64/2026 established a series of exceptions to the rule that, for medical leave certificates issued between 1 February 2026 and 31 December 2027, health insurance indemnities are calculated and paid with a one-day reduction. More specifically, such a reduction does not apply in the case of:
- Maternity leave;
- Medical leaves for caring for a patient with oncological conditions;
- Medical leaves for maternal risk;
- Medical leaves granted to patients included in national health programs; and
- Medical leaves granted to patients benefiting from hospital-based medical services.
The aforementioned exceptions apply to medical leaves granted starting on 1 June 2026.
Furthermore, the manner of their implementation is to be established within 30 days of the entry into force of Law 64/2026, by joint order of the Minister of Health and the President of the National Health Insurance House.
