bpvGS won by final ruling before CAS (The Court of Arbitration for Sport) in favour of the football player Lucian Sanmartean30 September 2013
The Court of Arbitration for Sport (CAS) decided in favour of the football player Lucian Sanmartean in the case file opened by the agent Horatiu Horoba, for the payment of EUR 200,000. The dispute was ruled by CAS’ final decision in favor of Sanmartean who was represented by bpv GRIGORESCU STEFANICA lawyers.
The trial started in 2012, when Horoba referred the case to the Romanian Footbal Federation (FRF) in order to obtain the amount of EUR 200,000 from Lucian Sanmartean, claiming that this is the amount Sanmartean owes him for negotiating the contracts the player concluded in 2010 and 2012 with FC Vaslui football club. Following the case file review and analysis, the National Dispute Resolution Chamber within FRF rejected Horoba’s request, based on the submitted evidence which proved that Sanmartean negotiated himslef the two contracts in question.
The file was then referred to the Appeal Commission within FRF, by the appeal filed by Horoba and subsequently to the Court of Arbitration for Sport in Lausanne. In agreement with the initial decision taken by FRF, CAS rejected by final ruling the request formulated by the agent, deciding that Horoba is not entitled to receive the requested amount.
The lawyers who assisted Lucian Sanmartean were Daniel Stefanica, partner, and Flavius Florea, associate with bpv GRIGORESCU STEFANICA.
