New measures implemented to prevent and combat the effects of Covid-19 pandemic

During the state of alert, the employers with more than 50 employees where the organization of work at domicile or in telework for at least 50% of employees is not possible, have the obligation to organize the work schedule in order to be suitably phased, starting at 7:30, respectively at 10:00, or divided into groups or shifts[1].

There are new amendments concerning the activities of certain economic operators in relation to the maximum space utilization, as follows[2]:

the activity with the public is allowed up to 50% of the maximum capacity of the space between 5:00 a.m.-10.00 p.m. in counties/localities where the Covid-19 cases rate during a period of 14 days is less than or equal to 3/1,000 inhabitants and not exceeding 30% in counties/localities where the Covid-19 cases rate during a period of 14 days is greater than 3/1,000 inhabitants for economic operators performing activities of preparation, marketing, and consumption of food and/or alcoholic and non-alcoholic beverages, such as restaurants and cafes, inside buildings and on terraces and the activity of restaurants and cafes inside hotels, boarding houses or other accommodation units, as well as on their terraces;

the activity with the public is allowed up to 50% of the maximum capacity of the space in counties/localities where the Covid-19 cases rate during a period of 14 days is less than or equal to 1/1,000 inhabitants and not exceeding 30% in counties/localities where the Covid-19 cases rate during a period of 14 days is greater than 1/1,000 inhabitants, for sports competitions, organization and development of the activity within the cinemas, performance institutions and/or concerts in confined or open spaces, organizing and carrying out specific activities in the diplomatic field, including at the headquarters of diplomatic missions and consular offices accredited in Romania, activity with the public of the economic operators that carry out the activity in confined spaces in the field of gyms and/or fitness, activity with the public of the economic operators that carry out activities of administration of the indoor swimming pools, activity with the public of the economic operators licensed in the field of gambling or who manage games rooms, activity of fairs and flea markets.

Starting with January 8, 2022[3], in all confined and open public spaces, it is mandatory to wear a medical with 3 folds or FFP2 (N95) type protective mask, so as to cover the nose and mouth (mask made of textile and/or plastic material is not allowed). Persons suffering from diseases affecting the oxygenation capacity, after the risk assessment carried out by the occupational physician of the unit, may be exempted from this measure at work.
