Establishment of quarantine measure

As of March 12th, 2020 Order no. 414/2020[1] for the establishment of quarantine measure for certain individuals in an international public health situation determined by the infection with COVID-19, as well as for the establishment of certain measures to prevent and limit the effects of the epidemic („Order 414/2020”) has entered into force.

According to Order 414/2020, quarantines means the institutionalised quarantine measure (in specially adapted places), as well as the home isolation measure.

The institutionalised quarantine measure is established for a period of 14 days for asymptomatic individuals who enter the Romanian territory from the areas with extended Community transmission affected by COVID-19 (red zones).

The home isolation measure is established for a period of 14 days for:

>> Individuals who travelled in the last 14 days to places from the areas affected by COVID-10, others than the red zones (yellow zones);

>> Individuals who have been in direct contact with individuals having symptoms and who travelled in extended transmission areas;

>> Individuals who have been in direct contact with individuals who have been confirmed with COVID-19;

>> Family members of an individual falling within one of the above-mentioned situations.

During the home isolation, the individuals will be monitored by the public health directorates or by the family physician, as the case may be.

The individuals in institutionalised quarantine or in-home isolation who are ensures in the public health system shall benefit during this time from medical leave, as well as from quarantine allowance. When the institutionalized quarantine or home isolation period is terminated, the public health directorate or the family physician, as the case may be, shall issue an epidemiological notice attesting the fact that the respective individual has been in institutionalized quarantine or in-home isolation. Based on such notice, the medical certificate for the institutionalized quarantine or home isolation period will be issued.

Failure to observe the institutionalized quarantine or in-home isolation measures constitutes a criminal offence and shall be sanctioned according to the Criminal Code.

Last, but not least, Order 414/2020 provides the fact that depending on the epidemiological situation and, in case more than three cases of related infection with COVID-19 are confirmed within the same community, it may be decided to declare quarantine within the respective community.
