New rules regarding the procedure for the annual endorsement of the environmental permit and the integrated environmental permit15 June 2020
By Order of the Ministry of Environment, Waters and Forests no. 1150/2020 (“Order no. 1150/2020”) the Procedure for the annual endorsement of the environmental permit and the integrated environmental permit was issued. The enactment was published in the Official Gazette of Romania on June 11th and will enter into force on July 11th.
Obtaining the annual endorsement is mandatory both for environmental permits and integrated environmental permits issued before the entry into force of Order no. 1150/2020, as well as for those issued after its entry into force, the purpose of this endorsement being to confirm that the holder of the permit is carrying out his activity under the same conditions for which it was initially authorized.
The activity owner will apply for the annual endorsement within a timeframe of 90 to 60 days prior to the passing of a year as of the date the initial permit was issued or revised.
The application for the annual endorsement shall be submitted with the public authority for environmental protection which issued the permit, together with the following documents:
► the annual environmental report and/or the reports mentioned in regulatory acts, if the case may be;
► a statement that the holder carries out the activity under the same conditions for which the permit was issued and that no substantial changes with respect to the conditions established by the permit;
► proof of payment of the fee.
The environmental permits and the integrated environmental permits for which the annual endorsement is not obtained will cease to produce legal effects and the activities owners shall have to undergo a new authorization procedure in order to perform the relevant activity.
